Homeowners' associations in Washington State are primarily regulated by their own governing documents, which include the Declaration of Covenants, Conditions, and Restrictions (CC&Rs), bylaws, and other association rules and regulations.

If a sufficient number of votes are cast in favor of the dissolution, the HOA is required to file Articles of Dissolution with the Florida Secretary of State. Thereafter, the HOA will be considered to be dissolved on the date specified in the Articles of Dissolution.

If your home is part of a condominium owners' association (COA) or homeowners' association (HOA) and you fall behind in assessments in Washington: The COA or HOA can usually get a lien on your home if you become delinquent in paying the assessments. After you default on the assessments, the COA or HOA may foreclose.

Unfortunately, there is no separate entity that governs homeowners associations in Washington. An HOA's Declaration of Covenants, Conditions, and Restrictions (CC&Rs) is what legally binds homeowners to the association. It's also one of the things that grant the association its authority. But, these covenants don't always last forever. In fact, it's entirely possible for CC&Rs to expire.

There may come a time when it's best to dissolve a property owners' association. In Texas, the legal procedure for dissolving an HOA is often outlined in the organization's governing documents. If this is not specified, a majority vote of the residents that make up the HOA is necessary to proceed with the dissolution.

They can take legal action against the HOA itself, seeking remedies such as injunctive relief or monetary damages to address the alleged failures. Alternatively, homeowners can pursue legal action against individual members of the board who are believed to have breached their fiduciary obligations.
