Man. New Jersey Nightly News with downturns and a good man in hand. Good evening. A landmark p*rnography trial in South Jersey creates more controversy. Boxing highlights and a preview of the garden staple tonight in sports with Bill Perry and the Democrats trying to beat the incoming Cain administration to the punch with a new congressional redistricting plan. Well the Jersey still has no idea how strong its p*rnography law is today. The first challenge to the state's recently revised obscenity law has ended in a hung jury in an Atlanta county court. Then Hodgman reports the case involves local standards of what is obscene and what isn't. They cover city is a small town of 5000 residents 20 miles northwest of Atlantic City. Group of citizens and church leaders here have been fighting to close down the adult world bookstore since it first applied for a mercantile license. A year and a half ago. Calling itself our forefathers Children the group says it has petitions opposing the bookstore with signatures of over 90 percent of the adults in the town throwing support from all the local civic groups they cover city

went to court to shut the bookstore down under New Jersey's obscenity law revised one hundred seventy nine to be a legal material must be patently or obviously offensive without a literary or scientific value and must appeal to the purity and interest when applying contemporary community standards. Superior Court Judge Anthony Gibson says the definition of what constitutes a community was crucial in the jury's decision. What would be constitutional or Linux any shouldn't be unconstitutional in Margate. And that constitutional framework requires that the material start to be controlled be examined within a larger community standard. That may not necessarily be the state. It may be the county but it's a very least a county. Gibson says his definition of community is based on prior legal decisions in the state and that the new law does not specifically define community or community standards. Our forefathers children groups as community standards in Egg Harbor City are very different from those in Atlantic City and that the law is flawed. It's one reason they say the national obscenity law center in New York calls New Jersey's obscenity law the weakest in the country isn't it.

cover city. Hundreds of New Jerseyans could be among some 2000 workers laid off on Christmas Eve by U.S. Steel's fellas works in Pennsylvania just across the river from Trenton. A company's spokesman says the layoffs are the result of a reduction in steel orders. Normally about a quarter of the plant's workforce of over 8000 is made up of New Jersey residents company and state officials say they don't know how many of the laid off workers will be from New Jersey. But that information may be available on Monday. The layoffs will idle almost half of Fairless works employees some of the workers will be recalled the first week of 1982 according to a spokesman. But it's not known how many. Atlantic City's casino industry earnings continue to expand. With the addition of the Tropicana Hotel Casino the ninth competitor to the gaming city which opened on Thanksgiving Day money taken in during November totaled totaled ninety seven point one million dollars for all of the casinos combined. The State

can see no control commission reports those earnings to be an average of three point six million dollars a day and that's 10 percent better than October's average Valley's Park Place took in about 15 million dollars. The new Tropicana reported 2.3 million dollars in earnings for November. Don. Also from South Jersey Atlantic Electric says it doesn't need its Millville coal fired generating station as much as it thought it would when the plant was proposed back in 1988. So completion of that plant will be put off until 1991. The South Jersey utility is citing two main reasons for the postponement of the project. The conservation of electricity by customers and the high cost of money and construction. The project now won't be started until 1987. The proposed 550 million dollar plan has drawn some protest from Millville residents who fear the coal plant will pollute their Cumberland County community. But a spokesman for the utility says those protests had no bearing whatsoever on their decision to delay the plant. State health officials say they found the cause of an outbreak of Hepatitis an Essex County doctor

reports. St. Benedict's prep school sits on High Street in Newark just a short block from Essex county's office buildings. In the last two weeks three employees and county offices have contracted type hepatitis. Two more cases are suspected. Four students at St. Benedict's have also gotten the same type of hepatitis. It's not considered anywhere near as serious as Type B hepatitis which may be deadly. One more type a case is suspected among students other than the proximity of the school to the offices. The state health department couldn't find out what all the victims had in common until today. It turned out everyone with hepatitis had eaten at this lunch stand in the basem*nt of the old Essex County Courthouse. The stand is operated by the state commission for the blind a blind employee wasn't wearing protective gloves while handling food. Some equipment was found dirty. Ironically Health Department inspectors discovered all this on December 5th during a check and they gave the stand a conditional approval after

operators promised to clean it up. But it took until today to interview all the hepatitis victims and isolate the cause. This morning before the lunch Stan was singled out Essex County executive Peter Shapiro described the situation as a small isolated outbreak of Hepatitis and said while there was cause for concern the situation was not serious. There have been no deaths. The symptoms are similar to a bad flu an injection of gamma globulin usually prevents the disease from taking hold. Some teachers at St. Benedict's have already gotten the injection and parents of students have been notified about the problem. Students parents and county employees are advised to see their physicians if they have reason to believe they may have contracted the disease. In Newark I'm dyin doctor. Police in Patterson tonight are continuing their roundup of suspected drug dealers in an operation that has resulted in 53 arrests so far. The drug bust which began yesterday are the result of a month long investigation into street corner drug sales. Police say

more arrests are expected soon. The crackdown called Operation straight sale by Patterson police is the largest undercover operation in the city's history. Charges of neglect of duty incompetence and inefficiency have been filed against two high ranking Union County Jail officials after the third suicide in that jail this year. Jail administrator James Scanlon and Warden Thomas Jefferson have been suspended without pay and they face dismissal now. The action came in the aftermath of prisoner McCord suicide on Tuesday. The 29 year old Verona woman hanged herself in an isolation cell. She was placed in that cell against regulations after she tried several hours earlier to kill herself. Lewis Collette a the acting head of union county's Correctional Services says the two faced an administrative hearing within 30 days. He also says a third man may be charged but that man has not been named to airlines at Newark Airport. Air Florida and New York air are taking off this time after no shows. Susan Esau's has the story.

There Florida's no show rate is running about 30 percent higher than ever and it's for daily flights out of Newark. Spokesman blame the air controllers strike saying the increased no shows are usually passengers who make several reservations to make sure they get on a convenient flight and then fail to appear for the other flights. Air Florida's new policy starting January 5th. Is in the form of an incentive to keep your reservation. Anyone flying to Fort Lauderdale West Palm Beach or Miami will get a $30 discount on weekdays provided they show up. If they do not use the ticket on the particular flight that they made the reservation for they they took it has absolutely no value at all they can't use it anymore they can turn it in for a refund they can use it for wallpaper. However we still offer the normal ticket where they are there is absolutely no penalty. New York air is no show rate is also at an all time high of about 30 percent on its four daily flights one Thanksgiving flight for example was 50 percent overbooked and less than a third of those with reservations appeared. The airline now charges $20 a ticket

for passengers who don't cancel at least 30 minutes before takeoff on its flight between Boston and Orlando. The program has been very successful on our flights from Boston and Baltimore to Orlando in fact we anticipated a no show factor in excess of 50 percent and we've really had a no show factor of about 5 percent on those routes. So if we ever fly to Florida from Newark and frankly we we've considered it in the past and I'm sure we'll consider it again in the near future. Will probably introduce the program there to keep the fares absolutely as low as possible. Both New York air and air Florida are low fare carriers charging up to two thirds less than other airlines flying similar routes and a big reason they've started penalizing no shows is to keep those fares low. Spokesman point out the door to make money they have to pass on no show cost in the form of higher ticket prices for everyone. And with the Christmas crunch coming the holiday message from the airlines is please call us if you don't plan to keep your reservation in Newark. I'm Susan nice loss. Port Authority has announced that starting next month a short term parking will cost a minimum of $2. As it is now short term parking costs $1 for each of the first two hours. Port Authority officials say the new $2 minimum will help offset higher operating costs than if you're not flying anywhere but going out to buy your Christmas tree this weekend these tips from Rolonda Watts might prove helpful. For many the Christmas tree is the center of attention around this time of year and for the cost conscious it might make your season a little more joyous to know. Tree prices haven't changed that much from last year. Growers are saying the most popular tree this year is the douglas fir. They last longer than the pine and have straight trunks and nice full branches. Growers say most people like the douglas fir because they even smell like Christmas. Now the Canadian balsam fir is a cousin of the douglas fir. They're the old fashioned Christmas tree

and great if you have a lot of fancy Christmas ornaments you want to show off. They're also one of the least expensive of the lot. Growers say one tree to watch out for is the spruce. They're pretty trees but they lose their needles very quickly. But if you insist on having that spruce grower suggest you cut your own for 20 dollars you can do that here Bear Swamp Christmas trees in Lawrenceville for a few dollars more you can buy a balled in burlap tree. Once Christmas is over planted in your yard how Smith grows Christmas trees here. He says if the tree you want to buy is yellowing don't panic. Some of the trees even growing when I read that people say gee let's tell the truth it's not that mainly that their leaders are cut down wherever because the weather turns on as the winter progresses they want to get more yellow. congressional districts before the Republican administration of time of Governor Tom Kaine takes office. Jim appointing our political correspondent is here to tell us where they stand. Jim can't congressional redistricting is a lot like trying to solve a Rubik's Cube infinitely complicated. You could play it by the book do it yourself and solve it in minutes. Or you could be like the Democrats play politics let everybody in on the act and take forever. Legislative aides today were rushing to Democratic drawn redistricting bills into position for a vote next week. But the basic snag remains. 15 congressman might squeeze into 14 redrawing districts. New Jersey having lost a seat to a faster growing state. Right now the state's congressional delegation is split. Eight Democrats seven Republicans. The disappearing district will be a Republican one if Democrats who hold slim majorities in the Senate and Assembly can pass a plan before Republican Tom Kaine is sworn in as governor next month. During Cain's reign

Democrats will have a smaller legislative majority and a few Democratic defectors could give the GOP the upper hand in redistricting. The actual redistricting maps are being drawn by Democrats behind closed doors in the state house and have not yet been released publicly. But at this point the principal proposal on the right differs considerably from the existing boundaries. It has the approval of the state's Democratic congressman but Bergen County Democrats are squabbling over it and Republicans will probably fight it in court if adopted it would put in the same district two Republicans first term in March Rock'em out of Ridgewood and three term congressman Harold Hollenbeck of East Rutherford. Also thrown into the same district would be Millicent Fenwick of Bennett's bill and James quota of Hackettstown. But one or the other is expected to run for Senate next year anyway. A separate redistricting bill has been filed by Bergen County Democrats who could use their sizable legislative delegation to block any other proposal.

And all this must be resolved before the April filing deadline for the June primary election. What happens to him if there isn't an agreement. Well there's always a possibility that the primary could be prolonged until it was postponed until late summer but as Chris Jackson the assembly leader said to me if the Democrats can't unite over this issue and the Republicans deserve to redraw those districts despite the fact that Tom came back from his post-election vacation we don't seem to see the pace of things picking up in the transition can we expect that he has he has promised his aides he came back last night and he's already said they're expecting the first Cabinet appointment by Wednesday.
